These Terms of Service (“Terms”) govern your access to and use of the Scaler Music community forum located at https://forum.scalermusic.com (the “Forum”).

The Forum is operated by Scaler Music Pty Ltd (“Scaler Music”, “we”, “us”, or “our”).

By accessing or using the Forum, including by creating an account or posting content, you agree to be bound by these Terms. If you do not agree, you must not access or use the Forum.

By using the Forum, you confirm that you meet this requirement and that you are legally able to enter into these Terms.

4.2 Licence to Scaler Music

You retain ownership of your User Content.

By posting User Content on the Forum, you grant Scaler Music a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, display, modify, distribute, and otherwise make available that User Content solely for the purposes of operating, promoting, improving, and maintaining the Forum and Scaler Music services.

This licence continues even if you stop using the Forum, to the extent necessary for the ongoing operation of the Forum (for example, retaining discussion threads).


5. Moderation and Enforcement

Scaler Music may, at its sole discretion and without prior notice:

  • Remove or edit User Content
  • Suspend or terminate accounts
  • Restrict access to the Forum

This may occur where we believe content or conduct:

  • Violates these Terms
  • Violates our Community Guidelines
  • Is harmful, unlawful, or inappropriate
  • Disrupts the Forum or other users

We are not obligated to monitor all content and do not guarantee the accuracy or reliability of User Content posted by others.


6. Community Guidelines

Your participation in the Forum is also subject to our Community Guidelines, which may be updated from time to time.

Community Guidelines form part of these Terms.


7. Third-Party Links and Content

The Forum may contain links to third-party websites or services.

Scaler Music does not control and is not responsible for third-party content, websites, or services. Accessing third-party links is at your own risk.


8. Intellectual Property

All trademarks, logos, branding, and proprietary materials displayed on the Forum are owned by Scaler Music or its licensors.

Nothing in these Terms grants you any right to use Scaler Music’s intellectual property without prior written consent.


9. Disclaimer

The Forum is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Scaler Music disclaims all warranties, express or implied, including warranties of accuracy, reliability, availability, and fitness for a particular purpose.

Content posted by users reflects the views of those users and not Scaler Music.


10. Limitation of Liability

To the maximum extent permitted by law, Scaler Music will not be liable for any indirect, incidental, special, or consequential loss arising out of or in connection with your use of the Forum.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be excluded.


11. Termination

You may stop using the Forum at any time.

Scaler Music may suspend or terminate your access to the Forum at any time, with or without notice, for any reason, including breach of these Terms.

Provisions which by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability.


12. Changes to These Terms

We may update these Terms from time to time.

Changes take effect when posted on the Forum. Continued use of the Forum after changes are posted constitutes acceptance of the updated Terms.


13. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of laws principles.

You agree to submit to the non-exclusive jurisdiction of the courts of Australia.
